Terms of Service

1. Acceptance of Terms

Welcome to Sociofy. By creating an account, accessing, or using the Sociofy website, application, and services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use the Services.

These Terms constitute a legally binding agreement between you (“User” or “Creator”) and Profile Labs (“Company,” “we,” “us,” or “our”), the operator of Sociofy.

2. Description of the Services

Sociofy provides creator-focused software tools, including but not limited to:

  • Multi-platform content publishing.
  • Performance analytics and insights.
  • Automated engagement and response features.
  • Social account management dashboards.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services strictly in accordance with these Terms.

3. Account Registration and Security

3.1 Eligibility

  • You must be at least 13 years of age to use the Services.
  • If you are between 13 and 18, you must have permission from a parent or legal guardian.
  • If you are using Sociofy on behalf of an organization or business, you represent and warrant that you have the authority to bind that entity to these Terms.

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are fully responsible for all activities conducted through your account.
  • You agree to notify us immediately of any unauthorized access or security breach.
  • Sociofy does not store plaintext passwords and uses industry-standard security practices, but we are not liable for loss or damage resulting from your failure to secure your account.

4. Acceptable Use and Restrictions

You agree to use Sociofy only for lawful purposes and in compliance with these Terms.

4.1 Prohibited Activities

You agree not to:

  • Use the Services to send unsolicited spam, bulk messages, or harass others.
  • Publish or distribute content that is illegal, hateful, violent, abusive, or sexually explicit.
  • Reverse engineer, decompile, or attempt to extract the source code of the Services.
  • Resell, lease, sublicense, or commercially exploit the Services without written permission.
  • Use the Services in violation of any third-party platform's terms (including Instagram, Facebook, TikTok, YouTube, LinkedIn, or Pinterest).
  • Interfere with, disrupt, or impair the integrity or performance of the Services.

4.2 Automation Rules

  • Automation features must be used responsibly and within platform-defined rate limits.
  • You are solely responsible for the content, configuration, and triggers of automated actions.
  • Automation must not be used for spam, harassment, or deceptive practices.

Violation of this section may result in immediate suspension or termination, without refund.

5. Third-Party Platforms

Sociofy integrates with third-party platforms using their official APIs (including YouTube API Services, Meta APIs, TikTok APIs, and others).

5.1 Platform Compliance

By connecting your accounts, you agree to comply with the applicable terms and policies of each platform, including but not limited to:

By connecting a YouTube account, you also agree to be bound by the YouTube Terms of Service.

5.2 No Responsibility for Platform Actions

Sociofy is a tool, not a platform operator. We are not responsible for:

  • API changes that limit or break features.
  • Account bans, restrictions, or shadowbans.
  • Content removal or policy enforcement by platforms.
  • Platform rule or policy changes.

Any restriction imposed by a third-party platform remains your responsibility, even if actions were performed through Sociofy.

6. Intellectual Property

6.1 Your Content

You retain full ownership of all content you upload or publish using Sociofy (“User Content”).

  • You grant Sociofy a limited, non-exclusive, non-transferable license to process, store, and transmit your content solely to provide the Services, such as publishing posts to connected platforms.
  • We do not use your content for marketing, resale, or training AI models.

6.2 Our Intellectual Property

All rights, title, and interest in the Sociofy platform, including software, design, branding, and trademarks, belong exclusively to Profile Labs. You may not use our intellectual property without prior written consent.

7. Payments and Subscriptions

7.1 Fees

Certain features require a paid subscription. Pricing and plan limits are clearly disclosed at the time of purchase.

7.2 Billing

  • Subscriptions are billed in advance on a recurring basis.
  • You authorize us to charge your selected payment method for all applicable fees.
  • Fees are non-refundable except as expressly stated below.

7.3 Refunds

We offer a 7-day refund window for first-time subscribers.

  • Refund requests must be submitted to mail@sociofy.bio within 7 days of the initial purchase.
  • After this period, fees for the current billing cycle are non-refundable.
  • Refunds are processed within 7-10 business days to the original payment method.

7.4 Pricing Changes

We may modify pricing with reasonable advance notice. Changes apply only to future billing cycles.

8. Cancellation and Termination

8.1 By You

You may cancel your subscription or delete your account at any time through your account settings. Cancellation takes effect at the end of the current billing period.

8.2 By Us

We may suspend or terminate access immediately, without prior notice or refund, if:

  • You violate these Terms.
  • Your use creates security, legal, or platform-compliance risk.
  • We are required to do so by law or platform policies.
  • Your account remains inactive for an extended period.

8.3 Appeals

If your account is suspended, you may submit an appeal within 14 days by contacting mail@sociofy.bio. Appeals are reviewed manually, and responses are typically provided within 7 business days.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
  • USING SOCIOFY WILL RESULT IN GROWTH, ENGAGEMENT, OR REVENUE.
  • CONTENT WILL ALWAYS PUBLISH SUCCESSFULLY DUE TO PLATFORM OR API LIMITATIONS.
  • THIRD-PARTY PLATFORMS WILL NOT CHANGE POLICIES OR APIS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFILE LABS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR $299 (USD), WHICHEVER IS LESS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

11. Indemnification

You agree to indemnify and hold harmless Profile Labs from any claims or liabilities arising from:

  • Your violation of these Terms.
  • Your content or automated actions.
  • Your violation of third-party platform policies.

12. Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including API changes, outages, cyberattacks, natural disasters, or governmental actions.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

To the extent permitted by applicable law, any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India. This does not affect your statutory rights under the laws of your country of residence.

14. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Profile Labs regarding the Services.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or dashboard notice. Continued use of the Services constitutes acceptance of the revised Terms.
